Terms of use.

1. Who we are, and who you are

Luthando App is published by Navario, a South African company ("Luthando", "the Institution", "we", "us"). By creating an account or using the service you agree to these terms. If you do not agree, please do not use Luthando.

You must be 18 or older to open an account. A child may use Luthando only through an account opened and supervised by their parent or legal guardian, who accepts these terms on the child's behalf and is responsible for the child's use of the service.

2. Your account

  • Give us accurate details, and keep them current.
  • Keep your password to yourself. You are responsible for what happens under your account.
  • Tell us promptly at info@luthandoapp.co.za if you think someone else has got in.
  • One account per person. Do not share a login so that several people can use one subscription.

3. Subscriptions, classes and what they cost

All prices are in South African Rand and include VAT where it applies.

With a valid school affiliation code, learners at an affiliated school pay R45/month for the subscription instead of the standard R90/month, 50% less on single lessons, and a further 10% off any 10-pack. Trial, renewal and cancellation

  • New accounts start with a free trial. You are told when it ends, and you are not charged during it.
  • A subscription renews each month until you cancel. You may cancel at any time — access continues to the end of the month you have paid for, and we do not charge you again.
  • Where you subscribed through the Apple App Store or Google Play, cancel through that store; their billing rules apply.
  • We may change prices. Existing subscribers will be told at least one month before a price change affects them.

Booking and cancelling a class

  • A class is confirmed once payment is received and the educator has the seat available.
  • Cancel more than 24 hours before a class and the lesson is returned to your account to rebook.
  • Cancel with less than 24 hours' notice, or miss the class, and the lesson is used.
  • If we or the educator cancel, or an Open Class does not reach its minimum of 10 learners, the lesson is returned to you in full — or refunded if you prefer.
  • Lessons in a 10-pack are valid for 12 months from purchase.

4. Live classes and conduct

Classes run on Luthando Live, our own meeting service. When you join a class:

  • Treat the educator and other learners with respect. Harassment, abuse, hate speech and sexual content are not tolerated.
  • Do not record, screenshot or redistribute a class without the educator's permission.
  • An educator may remove a participant who disrupts a lesson or puts others at risk.
  • Where a class is recorded, the educator will say so at the start.

Behaviour that endangers a child will result in immediate suspension and, where appropriate, a report to the authorities.

5. Teaching on Luthando

If you apply to teach, the following applies in addition to the rest of these terms.

  • You must be approved before you teach. You submit identity and qualification documents, and an administrator checks them by hand. Uploading documents does not by itself grant access, and replacing an approved document sends it back for checking.
  • Your teaching tools stay locked until your documents are approved and your banking details are on file.
  • You keep 88% of the class fee you set; the Institution keeps 12%. Your share settles into your own Paystack payout account.
  • You are an independent contractor, not an employee. You set your own availability and rates within the platform's bands, and you are responsible for your own tax.
  • You must hold any registration or clearance the law requires of a person working with children, and tell us immediately if it changes.
  • You keep ownership of the teaching material you create, and grant us a licence to host and deliver it to your learners.
  • We may suspend or remove an educator for safety concerns, repeated cancellations, or conduct that damages learners' trust.

6. Buying on the marketplace

  • The marketplace lists goods sold by independent sellers whom we vet before they may trade. The contract of sale for an item is between you and that seller; Luthando processes the payment, handles the platform, and holds sellers to these terms.
  • Delivery is charged per order: R80 in Gauteng, R150 in other provinces, or free if you collect from the seller.
  • You will be told when your order is on its way and when it is delivered, and you can track it in the app or on the website.
  • You may rate an item once it has been delivered to you. Ratings come only from real, completed purchases.

Returns, cancellation and refunds

  • Under section 44 of the Electronic Communications and Transactions Act, you may cancel an online purchase within 7 days of delivery without giving a reason. Return the item unused and in its original condition; you pay the cost of returning it, and we refund you within 30 days.
  • Under the Consumer Protection Act you may return goods that are defective, unsafe or not as described within 6 months, for a repair, replacement or refund.
  • Items made or personalised to your specification cannot be returned simply because you changed your mind.
  • If an order does not arrive, tell us and we will pursue it with the seller.

7. Selling on the marketplace

Any Luthando member may apply to open a store — you do not have to be an educator.

  • Your store must be approved before it goes live. You provide contact details, banking details, your registration document, ID and proof of bank, and at least one item with a price. An administrator reviews them.
  • Each item is approved too. Nothing appears in the shop until it has been checked, and editing a live listing sends it back for review.
  • You keep 87.5% of every sale; the Institution keeps 12.5%. Your share settles into your own Paystack payout account, and what you are owed is fixed at the moment of sale.
  • Best-rate undertaking. You undertake not to offer the same item at a lower price on any other channel — your own shop, another marketplace, or in person. If you drop your price elsewhere, drop it here too.
  • You are responsible for describing items honestly, holding the stock you list, packing and sending orders promptly, and keeping the order status up to date.
  • You must have the right to sell what you list. Counterfeit goods, unsafe goods, and anything unsuitable for a platform used by children are prohibited.
  • You handle returns in line with section 6 above, and with South African consumer law.
  • We may suspend a store or remove a listing that breaches these terms, and may withhold a payout while a dispute is being investigated.

8. Payments

Payments are processed by Paystack. Card details are collected on Paystack's secure page and never reach our servers. By paying you agree to Paystack's terms in addition to ours.

Where an order contains items from several stores, the payment is split so that each seller receives their own share directly. We keep only the commission set out above.

Refunds are returned to the method you paid with. Where we are satisfied a refund is due, we process it without delay.

9. Acceptable use

You may not:

  • use Luthando for anything unlawful, or to harm or exploit a child;
  • harass, threaten, impersonate or abuse anyone on the platform;
  • upload content that is unlawful, obscene, hateful or infringes someone's rights;
  • copy, scrape, resell or redistribute our lessons, stories, videos or class recordings;
  • interfere with the service, attempt to breach its security, or access another person's account;
  • circumvent payment, or use the platform to take a transaction off it in order to avoid commission.

10. Content and intellectual property

The Luthando name, logo, lessons, stories, games, videos and software are owned by Navario or licensed to us, and are protected by South African and international law. Your subscription grants you a personal, non-transferable licence to use them for your own family's learning — not to copy, resell or share them.

Content you upload — an educator's teaching material, a seller's product photographs, a review you write — remains yours. By uploading it you grant us a non-exclusive, royalty-free licence to host, display and distribute it as part of running the service.

If you believe something on Luthando infringes your copyright, write to info@luthandoapp.co.za with the details and we will investigate.

11. Child safety

Luthando is built for children, and safety takes priority over convenience.

  • Social features on a child's profile are off by default, and only a parent can turn them on.
  • Where messaging is enabled, a child communicates only with contacts a parent has approved.
  • Every educator is vetted by hand before teaching.
  • Report a concern to info@luthandoapp.co.za. We act on reports about a child's safety with priority, and will involve the authorities where we must.

12. Suspension and closure

We may suspend or close an account that breaches these terms, puts a child at risk, or is used fraudulently. Where it is fair to do so we will warn you first and give you a chance to put it right; where a child's safety is at stake we will act immediately.

You may close your account at any time — see the Privacy policy for how we handle your information afterwards.

13. Availability and liability

We work to keep Luthando running, but we cannot promise it will be uninterrupted or error-free. Classes depend on your own internet connection and device, which are your responsibility.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that South African law does not allow us to limit — including your rights under the Consumer Protection Act.

Subject to that, our liability to you for any claim connected with the service is limited to the amount you paid us in the three months before the claim arose. We are not liable for indirect or consequential loss.

Luthando is not a party to the contract of sale between a buyer and an independent seller, and we do not manufacture or inspect the goods listed. Your statutory rights against the seller are unaffected.

14. Changes to these terms

We may update these terms. The effective date above will change, and where an update materially affects you we will tell you in the app or by email before it takes effect. Continuing to use Luthando after that means you accept the updated terms.

15. Law and disputes

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.

If something has gone wrong, please tell us first — most things are settled quickly by writing to info@luthandoapp.co.za. If we cannot resolve it, you may refer a consumer complaint to the National Consumer Commission or an accredited ombud.
